Terms of Service

1. Acceptance of Terms

By accessing or using the Ascend Labs Canada website (the “Site”) or placing an order, you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree with these terms, you must not use the Site or purchase products from Ascend Labs Canada.

2. Research-Use-Only Products

All peptides, compounds, and related materials sold by Ascend Labs Canada are supplied exclusively for in vitro laboratory research, laboratory experimentation, and educational purposes. They are not intended for human or veterinary use, consumption, injection, inhalation, diagnosis, treatment, prevention of disease, or any therapeutic application.

Products have not been evaluated or approved by Health Canada or any other regulatory authority for human or veterinary use. No product listing, description, specification, website content, or communication from Ascend Labs Canada constitutes medical advice, a diagnosis, or a treatment recommendation.

By placing an order, you represent and warrant that:

• You are at least 21 years of age.
• You are purchasing for lawful laboratory research or on behalf of an appropriate research organization.
• You will use, handle, store, and dispose of the products only in accordance with applicable laws, regulations, and laboratory safety practices.

3. Age Verification

Access to the Site is restricted to visitors who are at least 21 years of age. On your first visit, you must confirm that you are 21 or older before accessing the Site.

When you confirm your age, the Site stores a first-party verification value in your browser’s local storage for approximately 30 days. This value records only that the age prompt was accepted. It does not store your birth date or other identity information.

Clearing your browser storage, changing browsers or devices, or using a private or incognito session may cause the prompt to appear again. By proceeding past the age-verification prompt, you confirm that the information you provide about your age is truthful and accurate.

4. Purchaser Responsibility

You are solely responsible for confirming that your purchase, possession, handling, storage, use, and disposal of any product comply with all laws and regulations applicable to you.

Ascend Labs Canada is not responsible for misuse of any product, including use involving humans or animals, use in food or cosmetic products, use contrary to product labelling, or any use other than lawful in vitro laboratory research.

5. Product Information and Availability

We make reasonable efforts to ensure that product descriptions, strengths, images, pricing, and availability are accurate. Product images are provided for general reference and packaging may vary by batch.

We reserve the right to correct errors, update product information, limit quantities, discontinue products, or refuse or cancel an order where necessary. If we cancel a paid order, any amount received for that order will be refunded.

6. Pricing, Orders, and Payment

All prices are displayed in Canadian dollars unless otherwise stated and may change without notice. Applicable shipping charges are shown during checkout.

Payment is made by Interac e-Transfer using the instructions provided after an order is submitted. An order is not considered paid or confirmed until the payment has been received and matched to the applicable order number.

Submitting an order does not guarantee acceptance. We may decline or cancel an order where product availability, payment verification, suspected fraud, purchaser eligibility, legal compliance, or other reasonable concerns arise.

7. Shipping and Delivery

Ascend Labs Canada ships only to addresses within Canada. Processing and delivery timelines are estimates and are not guarantees.

We are not responsible for delays caused by carriers, severe weather, service interruptions, incorrect or incomplete address information, or other events beyond our reasonable control. You are responsible for reviewing and confirming your delivery information before submitting an order.

Risk of loss passes to the purchaser upon delivery to the address provided at checkout, subject to any rights that cannot lawfully be excluded under applicable consumer-protection legislation.

8. Cancellations, Refunds, and Replacements

Order cancellations, refunds, replacements, damaged shipments, and incorrect orders are governed by our Refund Policy, which forms part of these Terms.

Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable consumer-protection laws.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, product descriptions, page layouts, and software, is owned by Ascend Labs Canada or used with permission and is protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify, republish, sell, license, or create derivative works from Site content without prior written permission, except for ordinary personal use of the Site.

10. Prohibited Conduct

You must not:

• Use the Site or any product for an unlawful purpose.
• Attempt to gain unauthorized access to the Site, checkout systems, order records, or supporting infrastructure.
• Interfere with Site security, availability, or operation.
• Provide false, misleading, or fraudulent information.
• Use Site content in a way that infringes intellectual-property or other legal rights.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.

Product-specific rights and remedies are governed by applicable law and our Refund Policy. Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by law, Ascend Labs Canada and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site, delay or inability to access the Site, or misuse of any product.

Where liability cannot be excluded, our total liability for a claim relating to a specific order or product will not exceed the amount paid for the product giving rise to the claim, except where a greater remedy is required by law.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Ascend Labs Canada and its owners, officers, employees, contractors, and affiliates from claims, liabilities, losses, damages, and reasonable costs arising from your unlawful use of the Site, misuse of a product, breach of these Terms, or violation of another person’s rights.

14. Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to any rights you may have under applicable consumer-protection legislation, disputes relating to these Terms, the Site, or an order will be submitted to the courts located in Ontario, Canada.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Your continued use of the Site after revised Terms are posted means that you accept the updated Terms.
